A dispute over Oklahoma’s skill to gather earnings taxes from sure Native Individuals has moved to the U.S. Supreme Court docket.

The U.S. Supreme Court docket is being requested to find out whether or not sure Native Individuals in Oklahoma are exempt from state earnings taxes below a earlier excessive court docket ruling.

The petition, filed in late September by Alicia Stroble, a citizen of the federally acknowledged Muscogee (Creek) Nation who lived and labored on the reservation, comes after the Oklahoma Supreme Court docket in July dominated in opposition to her problem, which hinged on the U.S. Supreme Court docket’s 2020 ruling in McGirt vs Oklahoma.

In a 6-3 resolution, the state court docket mentioned it was not empowered to use McGirt to state taxation.

In McGirt, the court docket affirmed about 42% of Oklahoma as tribal reservation land for legal regulation functions.

The Oklahoma Tax Fee has mentioned hundreds of taxpayers claimed exemptions from the state’s earnings tax within the wake of McGirt and that tax exemption for tribal members would end in “tens of thousands and thousands of {dollars} in tax refunds and deprive the state of billions extra in future taxes.”

Stroble’s petition contends that the U.S. Supreme Court docket “has repeatedly held that, absent congressional approval, states categorically could not tax the earnings of Indians who dwell and work inside their Tribes’ Indian nation.” 

“And the court docket lately held in McGirt that the Creek Reservation is Indian nation,” the petition mentioned. “These selections together dictate the right consequence right here: Oklahoma could not tax the earnings of Muscogee (Creek) Nation residents who dwell and earn earnings on the Creek Reservation with out congressional consent.” 

The Oklahoma Tax Fee has till Dec. 1 to file a response to the petition.

In 2022, Stroble filed an enchantment of the tax fee’s denial of her declare for an exempt tribal earnings exclusion for state earnings taxes paid for tax years 2017, 2018, and 2019 with the state Supreme Court docket. The fee had decided Stroble’s residency was not inside so-called “Indian Nation.”
